When is a permit required?

A building permit is required for any work which must conform to the NYS Title 19 Part 1203(a) Building permits (1) Building permits shall be required for work which must conform to the Uniform Code which includes the NYS Building, Residential, Existing Building, Fire, Property Maintenance, Fuel gas, Mechanical Codes, and Energy Code. Example include but not limited to:

Structural

  • Any erection, construction, enlargement, alteration, removal, demolition, conversion or change in the use or occupancy. If in doubt call or email the Building Department.
  • New Single or Multi Family Dwelling.
  • Sheds/ Accessory Structure (All accessory structure that have electricity must have a building permit)
  • Addition/Renovations
  • Demolition of any building, structure or any project that requires a building permit to construct.
  • Porches, decks, pool deck, arbors, sunrooms, greenhouses and gazebos
  • Satellite dishes (large ones, not DISH network or Prime star)
  • Accessory Apartments (also requires a Special Use Permit from Zoning board) There is no “Mother/Daughters” allow in the Town of Kent
  • Garages and carport (attached or detached)
  • Converting garage space in the living space
  • Finished Basements, Recreation Room and any previously unfinished
  • Replacement of any structural element of any project that requires a building permit (Deck shed, pool, stairs, etc.) replacement must comply with current Zoning and Building code. “There is no grandfathering”

Heating

Installation or Replacement of fuel fired appliance (furnace/boiler) including change of fuel Heat pumps, Fireplaces, Fireplace inserts, Gas fireplaces, Pellet Stove, Wood stove and Solar Thermal Systems.

Removal, Replacement, Installation or abandonment of fuel tanks 1000 gallons or more including propane tanks which are 500 lbs LP-gas.

Electrical system

Any new or additional wiring including but not limited to:

Central A/C, Ductless AC / Heat pumps, Upgrade to electrical system, Electrical transfer switches, Stationary generators. Solar electric modules and systems, electrical car charging stations.

Plumbing

Any new or replacement plumbing

Fuel Gases

LP gas, new piping and replacement, installation of LP tanks 3 or more

Exterior

  • Decks, Porches and Entryway – any size
  • Any pool deeper than 24” inches above or in ground
  • Hot Tub, spas
  • Fences higher than 6’ft. ( also need Zoning approval)
  • Shed/ Accessory Structures larger than 36’ Sq.Ft.(must meet zoning setback)
