FINAL MINUTES

 

The Zoning Board of Appeals of the Town of Kent held a Public Hearing at the Kent Town Hall, 25 Sybil’s Crossing, Kent Lakes, New York on Monday, October 15, 2018.  The meeting was called to order at 7:30 P.M by Mr. Gordon Moccio, the ZBA Chairman.  After due notice, the following members were present:

 

Present:

            Mr. Gordon Moccio, Chairman

            Mr. Ronald Hansen, Vice Chairman

            Mr. Joseph Greico

            Mr. Brett Harrison

            Ms. Jennifer Martinez

            Mr. Bill Walters, Building Inspector

           

Mr. Moccio opened the meeting by leading the Pledge of Allegiance.   Mr. Greico became a member of the ZBA at this meeting.

Requested a variance to vary the maximum distance from 50’ to 140’ for an extension of zoning district boundary into a less restricted zone.  Property is located on North Horsepound Road.

Mr. Moccio advised the audience that Ms. LoGuidice had submitted material which addressed all of the ZBA’s concerns and asked for a motion to grant the variance as requested by the applicant. 

 

The motion was made by Mr. Hansen and seconded by Joseph Greico.  Following were the roll call votes:

NEW BUSINESS:

 

  1. Joan Newman, 78 Peckslip Road, Kent Lakes, NY;  TM:  1.-1-14

 

Requested a 10’ rear variance for a proposed garage.Tax Map #1.-1-14.

 

Mrs. Newman attended the meeting and said that, after residing at this location for many years, she and her husband decided that they wanted to have a garage built on their property.

 

Mr. Hansen said that a site inspection had been done at this property and that there were no objections to granting the requested variance.

 

Mr. Moccio asked for a motion to grant the variance as requested.  The motion was made by Mr. Hansen and seconded by Ms. Martinez.  Following were the roll call votes:

  1. Steven Savod, 25 Homestead Drive, Kent Lakes, NY;  TM:  22.64-2-49

 

Requested a 4’8” side variance for a pre-existing 7’6” x 14’8” shed.

Tax Map # 22.64-2-49.

 

Mr. Savod said that he is in the process of selling his house and needed a permit for a pre-existing shed on his property.

 

Mr. Hansen noted that during the site visit it was discovered that there is a second shed on the property and suggested that this variance be amended to include the second shed.

 

Mr. Moccio asked for a motion to amend the variance and to approve it.  The motion was made by Ms. Martinez and seconded by Mr. Hansen.  Following were the roll call votes:

  1. Cindy Bravo-Sanchez, 97 West Lakeshore Drive, Kent Lakes, NY;  TM:  33.57-1-1

 

Requested a 6’ side variance to install a seasonal pool.Tax Map # 33.57-1-1

 

Ms. Bravo-Sanchez advised the ZBA that she would like a variance to install a seasonal pool on her property which she had purchased.

 

During the site visit the ZBA agreed that the location where the pool was to be placed was not suitable and posed serious safety concerns.They suggested that she withdraw her application and meet with the Building Department to get their advise as to where and how/if there was another location on the site which would be a better location.

 

  1. Bally Hack Management, 18 Bradley Court, Brewster, NY;  13-15 Dunwoody Rd.,

Kent, NY;TM:33.56-1-3

 

Requested an interpretation of whether or not an existing two-family dwelling located at 13-15 Dunwoody Road is a legal non-conforming residence.Tax Map # 33.56-1-3.

 

The applicant sent an email prior to the meeting asking that this matter be held over until the November meeting.

 

  1. Aproval of the August  ZBA Minutes

 

Mr. Moccio asked for a motion to approve the August Minutes.  The motion was made by Mr. Hansen and seconded by Ms. Martinez.  .  Following were the roll call votes:
